the police. what's the latest there? >> you can see crime tape is still up. just down the street is the crime scene. this is what we know right now. the san jose police respond to a call to an unknown disturbance this morning. police pulled up to the 1200 block of oxton drive and found a man shot dead. that person was inside the garage. we've also learned there were three other victims. those victims were shot at that same house. we learned they were attending some type of gathering, those four young men were attending a gathering. the suspects had already left the scene by time police arrived. minutes later, police found out those other three had walk into several other hospitals in san jose, each suffering from gunshot wounds. one of the victims is already. the other two we've learned were treated. no word on their condition.

here's what we don't know right now -- here's what police told us this morning. they don't know motive. they don't know if this is gang- related and they don't know if all of the victims knew each other. they also know there were several suspects. right now, everything is unclear. all they know, they received that one phone call. one man did not survive the shooting. we'll have more coming up from the police department. jade hernandez, ktvu channel 2 news. >> thank you, jade. a special education teacher from vallejo is behind bars this morning facing felony charges. he's accused of raining a developmentally-challenged aide. kraig debro -- of raping a developmentally-challenged aide. kraig debro has more. >> reporter: this happened on

the campus of low has ma vista -- loma vista elementary. school is out for the summer, so we don't expect to see anybody here this morning. ktvu is the only station of videotape of the suspect. 56-year-old jerry johnson was arrested at his home in elk grove around 5:30. he was then brought to vallejo. this is video of johnson being detained by -- by police. >> he didn't seem too knock -- too shocked by arrest. it's a heinous crime. >> reporter: johnson is being held on a $750,000 bond. police say johnson is not currently registered as a sex offender in this state. police say johnson teaches developmentally disabled kids between the ages of -- between

ages of 3 and 5. the victim is 18. she also attends school at hoe ma vista. police say even though the victim is 18, her mental capacity makes it impossible for her to give consent for such an intimate act. because her mental disability she's unable to give consent even though she's 18 to have sex with an adult. >> reporter: police say johnson has worked here for two years. right now, it's not clear if the school knows about the arrest. there's no sign on the school's website 0 or the district's -- website or the district's website about the arrest. police say this happened in february. we're trying to it find out why, then, did it take so long for the allegations to be brought forward, and what, if any, physical evidence still remains. kraig debro, ktvu channel 2

welcome back. 7:27. and right now as we speak, police in san jose are investigating a shooting that left one man dead, three others wounded. ktvu's jade hernandez has arrived there. she's right near the home where the shooting happened. good morning, jade. >> reporter: good morning. we can show you this morning that several squad cars and the crime scene is about a block away. you can see the command center right there with the information we've just learned, we can better describe details. san jose police are keeping us about a lock away from home where police say -- about about a block away from home where police say shots were fired. police say four young men had gathered inside of the garage. at this point, police believe several suspects walked you and opened fire right here in the 1200 block of oxton tribe. by time police arrived, they found only one body inside of the garage. the other three men made their way to two other local hospitals. police say they will survive

their injuries. we're definitely looking into all angles or aspects if, if you will, to determine if this was gang-related or if it was just a heated dispute. we really don't know. at this point, police don't have a motive. detectives are still trying to determine if this is gang- related. but they say the four victims that they had were not -- they do not believe were suspects in this the shooting. right now, they have one young man who was shot to death. three others who were shot and they still don't have a motive in the shooting but, of course, all of this is under investigation right now. reporting live from san jose, jade hernandez, ktvu channel 2 news. 7:29. 14 people are homeless this morning after a fire broke out in a san leandro apartment building. it start yesterday around 6:0 p.m. in a 66-unit building around haze and thornton -- hayes and

agent because he's deemed low risk. his parole is scheduled to end in one year. he served 11 months of a two- year sentence and received early release thanks to a year of conduct credit, there was no word on where he plans to live next. meanwhile, his legal troubles are not over yet. oscar grant's family has filed a multi-million dollar lawsuit against the officer. and the case is being reviewed to see if it warrants federal charges. some plaintiffs claim they were arrested unlawfully and mistreated during a protest

good morning. i'm tori campbell. >> i'm dave clark. it's tuesday, june 14th. well, a special ed teacher from vallejo is facing felony charges right now. he's accused of raping a developmentally challenged aide. kraig debro has more. >> reporter: the district superintendent stopped by and the administrator stopped by. you will hear from that administrator in a moment. this woman is 1878 but she's got a mind of a 7-year-old -- is 18. but she's got a mind of a 7- year-old. that's why this man is being charged with rape rape. he police say he was arrested at his home without incident. from there, he was transferred to vallejo where he now sits in the county jail. his name is jerry johnson. 57-year-old jerry johnson.

he teaches at loma linda elementary school. it's one count of april and specifically charge says it's rain a rape -- it's rape with a person who is not deciding consensual acts. that's basically what he's charged with. he's worked at the school for two years. we just spoke with one the superintendents here, mel jordan. he said he actually spoke with johnson while he was in jail yesterday. you talked to mr. johnson, then? >> no. the only time i talked to him was yesterday when we -- when we informed him he was being put on paid leave. >> did he say anything to you about the allegations? >> no. >> didn't deny it? >> all -- all i said weary putting you on paid leave -- all i said we're pitting you on -- putting you on paid leave and he wanted to know more about it and i told it -- and i told him it had to do with

misconduct. >> reporter: now, the school will be conducting their own investigation and will be putting out a later to parents about what happened. this happened in february. the girl didn't report it to her parents until early in the month. the school district was just notified a week or so ago that this was actually happening. right now jen -- jerry johnson was held in lieu of $750,000 bond. we don't have a precise day of his arraignment. the rule is 48 hours. it could be tomorrow he's arraigned or tomorrow. we'll look into that. kraig debro, ktvu channel 2 news. right now, we is a crew on the scene developing news in san jose. around 3:00 this morning, police responded to a disturbance on oxton drive. when they arrived, they found one man dead from gunshot wounds. shortly after that, three more people arrived at local hospitals also suffering from gunshot wounds. one is in critical condition. police believe all four were

shot while they were sitting in a garage at the home right now the suspects remain at large. coming up 234 about 30 minutes we'll have another live report from the scene. tonight, san francisco's police chief will talk about the deadly police shooting of a suspected southern california bank robber. officers say they were forced to shoot and kill 25-year-old joshua smith after he tried to run them over with a stole be car. it happened last tuesday near buena vista park. investigators believe smith was the so called jenex bandit e was called that due to his knit cap and plaid planle shirt which -- plaid fanle -- flannel shirt. 8:03. in about 30 minutes from now, first lady, michelle obama will be in berkeley. she will attend a breakfast event at the claremont hotel organized by super-star he chef, alice waters.

others with injuries. >> i took my granddaughter with me to work. i had to take her to work and i seen all of the cars and i was going to ask the police officers what's happening. i figured something was wrong because they don't come through here. >> reporter: san jose police arrived in the 1200 block of oxton drive, only to find a young man in his late teens early 20s shot to death. within the past few hours, we learned that now young men gathered inside the garage. they opened fire. whether or not they walked up to the garage or were already there, they are not sure. police say the three other men inside of the garage were shot and rushed themselves to two separate hospitals, leaving behind the young man who had been shot to death. police have not made any arrests this morning. >> we're definitely looking into all ainge the or aspect -- or aspects, if you will, to determine if this was gang- related or a heated dispute

between individuals. we don't really know. >> san jose detectives don't have a motive at this point. they say none of victims appear to be suspects. they are still looking for witnesses and police do not have a strings of the suspects this morning. but of course, all of this is still under investigation. squad cars, ticket police detectives -- squad cars, police detectives, they are all out here this morning. we'll continue to follow this story. back to you. thank you, jade. >> 14 people including four children need a place to live this morning after a fire at a san leandro apartment building. this fire started at a 66-unit building at hayes and thornton street. firefighters went door to door telling people they needed to get out of the building. >> it looked like roof was on fire. as soon as we came out, this area was basically a cloud of

black smoke. firefighters say five of the apartments inside are not fit to live in. the red cross is setting up temporary housing. everyone else was ahowed to go back into the building around midnight. the cause of the fire still under investigation. 8:30. a homeless woman is in jail this morning after she confessed to arson. this is san ralph nell hill located right next to the downtown area. yesterday, two different fires were set here about 30 minutes apart. homeowners in area say they saw a woman on hill just before the fires. she turned out to be 38-year- old hope windom. a regular resident of a nearby homeless camp. she was seen running down the hill and lo and behold she showed up to the police department a little while later and admitted doing the arson. police are not sure why she turn herself in or why she set fires. they say she might have mental issues because witnesses reported her shouting to

herself before the fires started. into homes were damaged and nobody was injured. controlled burns will continue near the santa rita jail. today's burn will take place from 8:00 to 3:00. 8:0. in the next couple of hours latest ruling in the same marriage in california. the judge decision -- you the judge's decision is expected to come down. a novato man faces several charges after threatening a woman with arrest and trying to run her off the road. 0 on sauer, woman -- on saturday, police say the woman reported this and he drove into her head-on swerving at the last minute to avoid hitting

that the prosecution has just one final witness to take the stand. and that will happen here in about an hour in downtown hold, upstairs behind me at the courthouse. the case for the prosecution moving more fast than they anticipated. and that's why we had an -- we ended early yesterday because today's final witness was not expected to be here until taos. so tomorrow after the prosecution wraps its case. defense is expected to spend about a week trying to remind this jury that all testimony so far shows that the relationship between caylee and her brother casey was nothing but a loving we lationship despite what prosecutors say -- relationship despite what the prosecutors say. the key will be the state.

if she's found guilty, the ther would spend another week or so doing a miniature trial specifically about aggravating and mitigating factors as to why the state feels casey anthony deserves to be sent to florida's death row. the jury saw a lot these photographs of casey anthony partying it up back in '08, when caylee was missing but the froms contend she was -- prosecutors contend she was dead. prosecutors say the day caylee died, that day casey anthony used cloe raw to -- to -- chloroform to force caylee into unconsciousness and used duct tape on her mouth. put her body in a bag, drone around with it for a few days -- drone around with it for a

few days. the defense says little caylee accidentally drowned in the back yard of her grandparents' swimming pool. it's also alleged that george anthony sexually abused casey when she was little. the defense is gonna have to back those statements up about that. and then it will be determine if casey anthony will take the stand. >> thank you, phil, for that update. joe ran van der sloot is scheduled to be in a -- joe ran van der sloot is scheduled to be in a courtroom. he's accused of killing stephany perez. this is the not first time he
